What happens when a parent who has custody of their children gives their children to the grandparent to raise?
Q. Well, my father has legal and physical custody of us, but we are living with our grandmother instead of our father. He comes to visit us every 2 weeks because he doesn't want to raise us. Can my mother regain custody of us since my father hasn't made any attempt to raise us? Is it possible? We are so tire of our parents being part-time parents. We would like to our mother to have us so that we can have at least one full time parent. So, would a judge grant my mother physical custody? Especially since she has her life together and she keeps us during summer breaks.

A. It's up to your Mom to make a move if she would like to have custody. She must file with the Court. In most states, the wishes of children at least 12-14 years of age hold a lot of weight in custody hearings; so, if you're old enough, you can help her regain custody. Before you do anything about this, though, think long and hard. If your mother has had some big problems like drugs or alcohol, it might be very difficult living with her. If your living situation with your grandparents is solid, you might want to just stay where you are. They must love you very much to step in and take care of you. Good luck to you.

How to win a custody battle when your ex is pushing the issue of mother having bipolar?
Q. My daughter has bipolar but has been a single mom to three shildren since they were born. Ages 3 1/2, 4 1/2 and newborn. The father has been in and out of their lives since they beginning. They got married last year and split up again after 3 months. He always tries to upset her and make her angry then calls the police and says she is a danger to her children (bipolar). She is breast feeding and can't take meds and is not a danger. She has provided a home, clothes, takes to doctors appts, school, etc. He doesn't even keep a job. He took the kids and filed for a divorce then they reconciled for a few months which made his custody papers null. He used them anyway and took the kids. Now we are going to court. Get these: 1) A statment from her doctor (psychologist) that indicates that her condition is stable, that he does not believe she is a risk to the children. 2) A statement from her children's doctor that indicates that they are healthy (well fed, weight appropriate for age, no signs of neglect or abuse). 3) A statement from the preschool or daycare (if there is one) that says that the children are socializing normally, clean and appropriately dressed, fed and ready for school. If the children appear to others (school, doctors, church members, neighbors) to be cared for, the fact that she is bipolar will have less weight. What is the process of gaining custody of a child in the state of California?
Q. My brother is willing to give custody of his son to us, how long is this process and what are the steps? We are stationed overseas in the military and don't have direct access to legal help (legal office here can't help), any advice would be greatly appreciated. My nephew is in the state of California. Thanks! Both of his parents are willing to let him come live with us, but the military requires we have legal custody of him before we can add him as a dependent. His home state is CA as is mine. We are stationed on a US military installation in Japan, I am just trying to get an idea of how long this can take if all parties involved agree. A. You don't provide enough information on this. It sounds like you want guardianship of your nephew, but being overseas, I don't see how this would work. I recommend that your brother consult an attorney here in CA. He can call the local bar association for a referral. These things can be very complicated depending on the facts (ie where is the mother?). Yahoo answers is no substitute for competent legal advice. No I am not an attorney so I have nothing to gain from stating this. There are too many jurisdictional questions here. It may depend on whether CA is your home state (per military designation/voting), as well as the child's home state (6 months continuous residency). Please consult an attorney, or have brother do so.
